Your privacy is important to Kourai, Inc. (“Kourai,” “we,” “us,” or “our”). Kourai provides a swimming pool computer vision safety product that includes Kourai hardware, a compute hub, software, a mobile application, websites, account features, alerts, subscription services, support services, documentation, and related products and services that link to this Privacy Policy (collectively, the “Kourai Service”). This Privacy Policy explains how we collect, use, disclose, store, and protect personal information in connection with the Kourai Service, our website, our mobile application, customer support, product purchases through channel partners, subscriptions, installation and reseller interactions, and other interactions that link to this Privacy Policy. Your use of the Kourai Service is also subject to our Terms of Service, available at https://kourai.com/terms, which govern your access to and use of the Kourai Service, including applicable terms relating to safety limitations, subscriptions, disclaimers, limitations of liability, and dispute resolution.

The Kourai Service is designed to use cameras, the Kourai Hub, and local computer vision technology to help users monitor activity in or around a swimming pool and receive informational alerts through the Kourai mobile application. Kourai does not use personnel to monitor pools, review live video, or verify alerts as part of normal operation of the Kourai Service.

1. Scope of This Policy

This Privacy Policy applies to personal information collected through the Kourai Service, our website, including https://kourai.com/, our mobile application, account registration, device registration, customer support, product purchases through channel partners, subscriptions, installation and reseller interactions, and other interactions that link to this Privacy Policy. It does not apply to third-party websites, services, platforms, retailers, resellers, installers, app stores, payment processors, or other third parties that we do not control.

For purposes of this Privacy Policy, “personal information” means information that identifies, relates to, describes, or could reasonably be linked to an individual or household. Personal information does not include information excluded from applicable privacy laws, such as publicly available information, deidentified information, or aggregated information.

We may provide additional privacy notices for specific products, features, locations, or legal requirements. If another notice applies to a particular interaction with us, that notice will supplement this Privacy Policy.

2. Information We Collect

Information you provide directly to us.

We collect personal information directly from you when you create an account, register a device, contact us, subscribe to services, or otherwise interact with us.

We may collect account and contact information, such as your name, email address, telephone number, postal address, account credentials, account settings, subscription status, communication preferences, device registration information, alert recipients, notification settings, and other information you provide when you create an account, register a device, contact us, subscribe to services, or otherwise interact with us.

We may collect purchase-related, billing, warranty, return, and subscription information, such as products purchased through channel partners, subscription plan, renewal status, transaction history, order information, shipping information, payment status, cancellation status, warranty or return status, chargeback or payment-dispute information, and related records. Payments may be processed by a third-party payment processor, such as Stripe or another provider, and Kourai does not store full payment-card numbers.

Information we receive from third parties.

We may receive personal information from third parties, including service providers, security system sellers, security dealers, installers, integrators, distributors, payment processors, app stores, analytics providers, and other parties involved in providing or supporting the Kourai Service.

Kourai hardware may be sold, installed, configured, serviced, or supported through security system sellers, security dealers, installers, integrators, distributors, or other channel partners. Those third parties may collect and process purchase, payment, installation, scheduling, support, and related transaction information under their own terms and privacy policies. Kourai may receive limited information from those parties as needed to register or activate the product, administer subscriptions or account features, coordinate installation or support, manage warranty or return matters, communicate with you about the Kourai Service, and comply with legal, security, or operational requirements.

Information we collect automatically.

We collect certain personal information automatically through your use of the Kourai Service, our website, our mobile application, devices, and related technologies.

We may collect device, network, and diagnostic information, such as device identifiers, Kourai Hub status, camera configuration, firmware and software version, update status, mobile app version, router or connectivity status, IP address, approximate location derived from IP address, system logs, alert delivery status, calibration information, error reports, performance data, and similar technical information. If you use the mobile application, we may request permission to access certain device features, such as camera, Bluetooth, location, SMS functionality, or push notifications, depending on the features you use and your device settings.

We may collect website and analytics information, such as browser type, device type, operating system, pages visited, time spent on pages, referring pages, interactions with our website, cookie identifiers, and similar information collected through cookies, pixels, and similar technologies.

We may collect support and communications information, such as the content of messages you send us, support requests, feedback, survey responses, call or text preferences, authentication messages, service notices, product notices, subscription notices, billing notices, outage notices, and related communications.

The Kourai Service may process video, images, camera streams, pool-area information, user-created profiles and recognition settings, alerts, alert delivery information, event history, recordings, and related pool-monitoring information through the user’s Kourai hardware, Kourai Hub, devices, local network, and product configuration. Access to locally stored content is controlled by the end user, and access to certain recordings, event history, alerts, or other subscription-dependent features may depend on account status, subscription status, device status, and available product controls.

3. How We Use Personal Information

We use personal information for the following purposes:

  • Provide, maintain, secure, troubleshoot, and support the Kourai Service, including account registration, device registration, subscription administration, product setup, app-based alert delivery, customer support, warranty support, reseller and installer coordination, and related service functionality.
  • Process purchase-related matters through channel partners, subscriptions, renewals, cancellations, returns, exchanges, refunds, taxes, payment disputes, chargebacks, and related billing and transaction matters.
  • Operate, test, maintain, secure, debug, repair, update, improve, and develop the Kourai Service, including software, firmware, mobile app features, account features, alert features, detection features, and related product functionality.
  • Send administrative, transactional, service, product, security, subscription, billing, outage, support, and other non-marketing communications related to your account, devices, subscription, or the Kourai Service.
  • Send marketing or promotional communications about Kourai products and services, subject to your opt-out rights described in this Privacy Policy.
  • Understand how visitors use our website, measure website performance, improve website content and functionality, diagnose technical issues, and evaluate the effectiveness of limited website-related communications and product information.
  • Comply with law, respond to legal process, enforce our terms and policies, protect our rights, privacy, safety, property, users, and the Kourai Service, prevent fraud or security incidents, and support a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar business transaction.

4. Facial Recognition, Biometric Information, and Profile Matching

The Kourai Service may include facial recognition, profile-matching, or similar features that support user-created profiles and pool-monitoring functionality. The Kourai Service is intended only for informational pool-monitoring purposes and are not intended for identity authentication, legal identification, security access control, law enforcement, employment, tenant screening, credit, insurance, eligibility, healthcare, childcare, or other regulated or high-risk decisions.

Users may choose to create optional profiles or recognition settings for known individuals, and Kourai does not use biometric information generated through normal on-premises operation for advertising, marketing, cross-context behavioral advertising, or to train general-purpose models.

Depending on your location and how the Kourai Service is configured, facial recognition templates, face geometry, faceprints, or similar data may be considered biometric identifiers, biometric information, sensitive personal information, or another specially regulated category of information. Some laws may require advance notice, consent, written releases, retention disclosures, or other safeguards before biometric information is collected, used, or disclosed.

Facial recognition, person-recognition, and profile-matching features are designed to be processed and stored locally through the user’s Kourai hardware, Kourai Hub, devices, local network, and product configuration. Kourai does not ordinarily possess or control biometric identifiers or biometric information generated through normal on-premises operation of the Kourai Service. To the extent Kourai does possess or control biometric identifiers or biometric information within the meaning of applicable law—for example, in connection with support, troubleshooting, security, product improvement, or another user-authorized interaction—Kourai will use, retain, and delete that information as required by applicable law.

You are responsible for using these features lawfully, including providing any notices, obtaining any consents or written releases, honoring applicable rights requests, and limiting capture or recognition to areas and individuals for which you have lawful authority, as required by applicable privacy, biometric, surveillance, recording, consent, notice, landlord-tenant, employment, childcare, consumer-protection, and other laws.

5. Video, Images, Alerts, and Local Content

The Kourai Service uses cameras, the Kourai Hub, computer vision, artificial intelligence, machine learning, recognition features, and similar technologies to analyze activity in or around a monitored pool and generate alerts or other informational outputs. Core pool-monitoring features are designed to operate locally on the user’s Kourai hardware and Kourai Hub, with local data storage and no cloud computing required for core processing. Except as described in this Privacy Policy or with your authorization, Kourai does not access live or recorded video or locally stored pool-monitoring content through normal operation of the Kourai Service.

Video, image, recognition, alert, and related pool-monitoring processing is provided for informational pool-monitoring features only. Kourai does not use personnel to monitor pools, review live video, verify alerts, contact emergency responders, provide 911 or dispatch services, or provide professional monitoring as part of normal operation of the Kourai Service.

6. Cookies, Google Analytics, and Similar Technologies

Our website may use cookies, pixels, tags, and similar technologies to operate the website, remember preferences, understand website use, measure performance, and improve our website and services. Most browsers allow you to refuse or remove cookies, but some website features may not function properly if cookies are disabled.

We use Google Analytics to collect and analyze information about use of our website and to report on website activities and trends. Google Analytics uses cookies or similar technologies to measure user interaction, and Google states that its customers must not send information to Google Analytics that Google could use or recognize as personally identifiable information except as permitted by Google’s policies and terms.

Google’s terms require websites using Google Analytics to disclose the use of Google Analytics and how Google Analytics collects and processes data, including by providing a prominent link to Google’s explanation of how Google uses information from sites or apps that use Google services. If we use Google APIs in connection with the Kourai Service, our use of information received from Google APIs will comply with the Google API Services User Data Policy, including the Limited Use requirements.

Google provides a Google Analytics opt-out browser add-on that is designed to allow website visitors to prevent their data from being used by Google Analytics on websites using supported versions of Google Analytics JavaScript. The add-on is available for supported browsers, including Chrome, Safari, Firefox, and Microsoft Edge, and can be downloaded at https://tools.google.com/dlpage/gaoptout.

Some browsers offer a “Do Not Track” signal. Because there is not currently a uniform industry standard for recognizing or responding to Do Not Track signals, our website does not respond to Do Not Track signals. You can also control cookies through your browser settings, although disabling cookies may affect some website features. We do not currently use Google Analytics Advertising Features, retargeting, or cross-context behavioral advertising. If our practices change, we will update this Privacy Policy as required by applicable law.

7. How We Disclose Personal Information

We may disclose personal information in the following circumstances:

  • To vendors, service providers, contractors, and other third parties that help us operate our business and provide the Kourai Service, including hosting providers, cloud infrastructure providers, analytics providers, customer support providers, payment processors, shipping providers, app stores, communications providers, security providers, professional advisors, and other companies that perform services on our behalf.
  • To security system sellers, security dealers, installers, integrators, distributors, and other channel partners where necessary to process purchases, coordinate installation, activate products, provide support, manage warranty or return matters, administer subscriptions, or otherwise support the Kourai Service.
  • If we believe disclosure is reasonably necessary or appropriate to comply with law, legal process, subpoenas, court orders, government requests, regulatory obligations, law-enforcement requests, or other legal requirements; to enforce our agreements and policies; to protect the rights, safety, privacy, property, or security of Kourai, our users, or others; or to detect, investigate, prevent, or respond to fraud, security incidents, misuse, or unlawful activity.
  • In connection with an actual or proposed merger, acquisition, financing, investment, reorganization, bankruptcy, sale of assets, corporate transaction, or similar business transaction.
  • With your consent, at your direction, or as otherwise described when the information is collected.

We do not disclose customer video, camera streams, recognition profiles, family profiles, locally stored pool-monitoring content, or similar customer-controlled content to third-party companies for their own marketing or independent commercial purposes.

We do not sell personal information for money. We also do not share personal information for cross-context behavioral advertising or targeted advertising unless we update this Privacy Policy and provide any notices and choices required by applicable law.

8. Your Privacy Choices

You may access, update, or correct certain account information through your account settings or by contacting us. You may also be able to configure device settings, notification settings, account permissions, alert recipients, and local product settings through the Kourai Service.

You may opt out of marketing emails by using the unsubscribe link in those emails or by contacting us. Even if you opt out of marketing communications, we may still send you non-marketing communications, such as service, product, security, support, subscription, billing, legal, and administrative messages.

You may manage cookies through your browser settings and may use the Google Analytics opt-out browser add-on described above. Disabling cookies or similar technologies may affect website functionality.

You may delete, export, or manage video, images, profiles, recognition settings, alert history, and related pool-monitoring content to the extent the Kourai Service provides those controls. Some content may be stored only on your devices or local network and may not be accessible to Kourai.

Some content or service features may be unavailable, limited, deleted, or inaccessible after cancellation, termination, payment failure, subscription lapse, hardware transfer, device reset, or changes to account, device, or local storage settings, subject to applicable law and available product controls.

9. State Privacy Rights

Residents of certain U.S. states may have privacy rights under applicable consumer privacy laws, depending on where they live, the nature of the personal information at issue, and whether Kourai is subject to the relevant law. These rights may include:

  • Request access to or a copy of personal information.
  • Request deletion of personal information, subject to applicable exceptions.
  • Request correction of inaccurate personal information.
  • Request portability of personal information, where applicable.
  • Request information about categories of personal information collected, used, disclosed, sold, or shared, where applicable.
  • Opt out of certain processing activities, such as targeted advertising, sale or sharing of personal information, or certain profiling activities, where applicable.
  • Limit certain uses or disclosures of sensitive personal information, where applicable.
  • Appeal certain decisions and not be discriminated against for exercising applicable privacy rights.

The privacy rights available to you may depend on your state of residence, the nature of the personal information at issue, and whether the applicable law applies to Kourai or to the relevant processing activity. We will honor privacy rights and provide state-specific notices, choices, and request processes to the extent required by applicable law.

To submit a privacy request, you may contact us using the information in the “Contact Us” section below. We may need to verify your identity and authority before fulfilling a request. If you submit a request on behalf of another person, we may require proof of authorization and may also require the individual to verify their identity directly with us.

California “Shine the Light” Law. California residents may request information about our disclosure of certain personal information to third parties for their own direct marketing purposes during the preceding calendar year, if applicable. To make a request, please contact us using the information in the How to Contact Us section below.

10. Children’s Privacy

The Kourai Service is intended for purchase, installation, configuration, and use by adults and is not directed to children. We do not knowingly collect personal information directly from children under 13 through our website or account-registration process. If we learn that we have collected personal information directly from a child under 13 without legally required consent, we will take steps to delete that information as required by law.

11. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information in our possession or control. However, no method of transmission, storage, processing, or electronic security is completely secure, and we cannot guarantee absolute security.

12. Data Retention

We retain personal information for as long as reasonably necessary to provide, maintain, support, secure, and improve the Kourai Service; administer accounts and subscriptions; process transactions; provide customer support; comply with legal, accounting, tax, audit, and recordkeeping obligations; resolve disputes; enforce agreements; and protect our rights and the rights of others.

Retention periods may vary depending on the type of information, the purpose for which it is used, legal requirements, operational needs, backup and archival practices, account status, subscription status, device status, local storage settings, available product controls, and whether the information is stored by Kourai or only locally on the user’s devices or network. If information is stored only locally through the Kourai Service, the end user may be responsible for deleting or managing that information through available product controls.

Stored recordings, event history, alerts, or other subscription-dependent content may no longer be available after cancellation, termination, payment failure, subscription lapse, hardware transfer, device reset, or other changes affecting account, device, or service status.

13. Third-Party Websites, Services, and App Stores

The Kourai Service, our website, or our communications may include links to third-party websites, app stores, marketplaces, reseller websites, installer websites, payment processors, or other third-party services. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy, security, or data practices. You should review the privacy policies and terms of those third parties before interacting with them.

14. U.S.-Only Availability

We do not currently offer the Kourai Service outside the United States. If you access or use the Kourai Service from outside the United States, you understand that personal information may be processed in the United States, where laws may differ from those in your location.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we may provide notice through the Kourai Service, by email, on our website, in the mobile application, or by other means required by applicable law. The “Last Updated” date above indicates when this Privacy Policy was last revised.
